Factory Calendar 2023
Article 68 of the Labour Code of the Republic of Kazakhstan (hereinafter – the Code) specifies that normal duration of working hours should not exceed 40 hours in a week.
An employment contract may provide for a shorter duration of working time with the same amount of remuneration paid as for the normal duration of working time.
The Code also provides for the reduced working hours for certain categories of employees:
for employees at the age from fourteen to sixteen – no more than 24 hours per week (Article 69 of the Code);
for employees at the age from sixteen to eighteen – no more than 36 hours per week (Article 69 of the Code);
For employees engaged in heavy work, work with harmful and (or) dangerous working conditions, the reduced working hours are established – not more than 36 hours per week according to the List of industries, workshops, professions and positions, the list of heavy work, work with harmful and (or) dangerous working conditions (Article 69 of the Code);
for disabled employees of first and second groups – no more than 36 hours per week (Article 69 of the Code).
In accordance with Article 79 of the Code, organizations must keep records of working time actually worked by the employee.
With a five-day working week, the duration of daily work (work shift) cannot exceed:
- 8 hours at a weekly rate of 40 hours,
- 7 hours 12 minutes at a weekly rate of 36 hours;
With a six-day working week, the duration of daily work (work shift) cannot exceed:
- for employees with a weekly rate of 40 hours – 7 hours;
- with a weekly rate of 36 hours – 6 hours, etc.
In this regard, the duration of working time is:
With a 40-hour working week:
– with a five-day working week – five work days of 8 hours long;
– with a six-day working week – five work days of 7hours long and one work day of 5 hours long.
With a 36-hour working week:
– with a five-day working week – five work days of 7 hours 12minutes long (7,20 hrs);
– with a six-day working week – six work days of 6 hours long.
In accordance with the Law of the Republic of Kazakhstan No. 267-II dated 13 December 2001 “On Holidays in the Republic of Kazakhstan” (hereinafter – the Law), days on which national and public holidays are celebrated in the Republic of Kazakhstan are recognized as holidays in accordance with the labor legislation of the Republic of Kazakhstan.
Holidays in the Republic of Kazakhstan are non-working days.
If a day off and a public holiday coincide, the day off is the next working day after the holiday.
Holidays celebrated in the Republic of Kazakhstan:
national holiday:
The Republic Day – 25 October;
public holidays:
New Year – 1-2 January;
International Women’s Day – 8 March;
Nauryz Meiramy – 21-23 March;
Kazakhstan People’s Unity Day – 1 May;
Defender of the Fatherland Day – 7 May;
Victory Day – 9 May;
The Capital City Day – 6 July;
The Constitution Day of the Republic of Kazakhstan – 30 August;
The Independence Day – 16 December.
In this connection, when compiling the balance of working hours in 2023, taking into account the norms of the Law, holidays coinciding with days off (Saturday, Sunday) are shifted to the next working day after the holiday:
with a five-day working week:
from 1 January to 3 January;
from 7 May to 8 May;
from 1 July to 7 July;
from 16 December to 18 December;
with a six-day working week:
from 1 January to 3 January;
from 7 May to 8 May.
In accordance with Article 84 of the Code, with five-day and six-day working weeks, the general day off is Sunday.
The second day off with a five-day working week is established by a collective agreement or labor regulations.
The first day of Qurban-Ait, celebrated according to the Muslim calendar, January 7 – Orthodox Christmas are days off.
In 2023, the first day of Qurban Ait falls on 28 June.
The factory calendar prescribes the standard duration of working time for months, quarters and for the year 2023 as a whole in working days (hours). It was calculated on the basis of five-day and six-day working week calendar for eight-, seven- and six-hour working day with a 40-hour and 36-hour working week.
In 2023 the standard duration of working time comprises:
with a 40-hour working week:
five-day working week – 1968 hours (246 days * 8,00 hours);
six-day working week – 1979 hours (247 days * 7,00 hours + 50 days * 5,00 hours);
with a 36-hour working week:
five-day working week – 1771.20 hours (246 days * 7.20 hours);
six-day working week – 1782 hours (297 days * 6.00 hours).
The average monthly number of work days in 2023:
with a five-day working week – 20.50 days;
with a six-day working week – 24.75 days.
The average monthly number of calendar days in 2023 is 29,33 (without holidays established by the legislation of the Republic of Kazakhstan).
