The deputies of the Senate (upper house) of the Kazakhstan Parliament passed the Law “Concerning Introduction of Amendments and Additions to Certain Constitutional Laws of the Republic of Kazakhstan related to Improvement of the Civil Procedural Law”, Zakon.kz informs. 

As noted in the report of the Senate Committee, the draft Constitutional Law provides for the introduction of amendments to the constitutional laws “Concerning Elections in the Republic of Kazakhstan and ”Concerning the Judicial System and the Status of Judges of the Republic of Kazakhstan, which are aimed at bringing them in compliance with provisions of the draft Civil Procedural Code.

“Considering that the draft code introduces the institute of appeal of judicial decisions affecting the electoral rights of citizens, the Constitutional Law “Concerning Elections in the Republic of Kazakhstan” is amended by excluding the provisions related to the finality of decisions of the courts of first instance issued on such cases, “- states the report of the specialized committee.

In addition, the list of categories of cases reviewed by the Supreme Court is expanded by referring all cases related to appealing decisions and actions (inaction) of the Central Election Commission.

The Constitutional Law “Concerning the Judicial System and Status of Judges of the Republic of Kazakhstan” is amended by adding clauses providing for the creation of the specialized judicial board at the Supreme Court, as well as those aimed at the fulfillment of the Nation’s Plan for the implementation of the five institutional reforms of the State.
